What information we collect and use, and why

We collect and use your personal information for the purposes of discharging our obligations in connection with the “Holding Period Trust Deed” between Bank of Baroda (UK) Limited (as “Settlor”), The Law Debenture Trust Corporation p.l.c. (as “Trustee”) and Bank of Baroda, London Branch (as parent of the Settlor), dated 03.11.2025 (the “Trust Deed”). Under the Trust Deed, following the closure of the Settlor’s business and as part of our appointment as a Trustee, we handle the money disbursement process on behalf of the Settlor to ensure all relevant beneficiaries receive the money they are entitled to under the Trust Deed.

In order for us to verify the money claim and identity of each beneficiary and before we can make any payments to each beneficiary, we must collect the following information:

·    Bank account details

·    Contact details (including but not limited to full name, address, telephone number, and/or personal email address)

·    Date of birth

·    Nationality

·    National Insurance number

·    Copies of passports or other photo ID

·    Copies of proof of address documents (such as bank statements or bills)

·    Next of kin or emergency contact details

Lawful basis and data protection rights

Under UK data protection law, we must have a “lawful basis” for collecting and using your personal information. There is a list of possible lawful bases in the UK GDPR. You can find out more about lawful bases on the ICO’s website.

·    Your right of access - You have the right to ask us for copies of your personal information. You can request other information such as details about where we get personal information from and who we share personal information with. Our lawful bases for the collection and use of your data

Our lawful basis for collecting and using your personal data is:

·    Contract – we have to collect and use your personal data in order to carry out and hold a record of how we discharged our obligations under the Trust Deed. All of your data protection rights may apply except the right to object.

Where we get personal information from

We collect your information from the following places:

·    Directly from you

·    From Bank of Baroda (UK) Limited/ Bank of Baroda, London Branch

How long we keep information

·        Information records received from Bank of Baroda (UK) Limited and Bank of Baroda, London Branch and instruction certificates completed by each beneficiary will be kept for up to 24 years. This period covers the 12 years duration of the Trust Deed and an additional period of 12 years following the expiry of the Trust Deed. This is to enable us to process the payments to the relevant beneficiaries and hold records of the payments made throughout the duration of the Trust Deed and for the full length of the relevant limitation period (i.e. the period beneficiaries and other parties to the Trust Deed may issue legal proceedings against us).

·        KYC documents will be kept for up to 17 years. This period covers the 12 years duration of the Trust Deed and an additional 5 years following the expiry of the Trust Deed to account for any KYC retention period requirements starting with the date of the last possible beneficiary claim under the Trust Deed .

Who we share information with

We are committed to respecting your privacy and will share your personal data only with a number of trusted third parties who work with us to help us meet our obligations under the Trust Deed, in order to fulfil our legal obligations, and/or at your request, including but not limited to:

·        other members of LawDeb Group, as necessary to operate our business;

·        payment providers who help us manage payments;

·        solicitors and professional service firms who provide us with legal, audit, accountancy and consultancy services and other support;

·        service providers who help operate our IT security, storage and back office systems;

·        regulators and other authorities;

·        any third party at your request; and/or

·       any other person that requires access to or receipt of your personal data in connection with the Trust Deed and discharging the obligations we have towards you as a beneficiary including but not limited to:

If we have any difficulties in verifying a beneficiary’s identity, we may contact Bank of Baroda (UK) Limited to ask them if they have any further information in their files about that particular beneficiary. This may assist us with the completion of the identity verification process.

Yoti Ltd. 

Yoti Ltd. is a global digital identity and biometric technology company that processes know your customer requests. We use Yoti Ltd to verify your identity before processing any relevant payments to you.

Once we receive your data, we use appropriate procedures and security features to prevent unauthorised access. We require any third-party service providers who act as data processors for us to do so too and to comply with applicable data protection laws as part of our contract with them. These service providers may, with our agreement, sub-contract certain processing activities, for example to external printing companies, data analytics providers or software providers. Before doing so, they must check that the sub-contracted service provider has adequate security measures in place.
